ChemData MiniApps — Individual Single-User Licence Terms
Provider: SafeChemEdu
Licence type: Individual Single-User Licence
Delivery model: Hosted online application
Standard licence period: 12 months from Activation Date
1. Scope
These licence terms apply to a ChemData MiniApp purchased as an individual standalone product from SafeChemEdu.
The specific MiniApp purchased, its product name, product code, purpose, principal functions and entitlement identifier are set out in the applicable Product Schedule or customer order.
These terms apply together with that Product Schedule.
2. Licence grant
SafeChemEdu grants one named individual a limited, non-exclusive and non-transferable right to access and use the ChemData MiniApp identified in the applicable Product Schedule or order.
The licence provides access to the MiniApp as a hosted service. It does not transfer ownership of the software, source code, application architecture, templates, designs, databases, system structures or other SafeChemEdu intellectual property.
3. Licence term
Unless otherwise stated in the applicable Product Schedule or order, the licence continues for 12 months from the Activation Date.
The Activation Date is the date SafeChemEdu first provides the customer with working access to the purchased MiniApp following purchase.
4. Single-user scope
The licence is assigned to one named individual, one verified email address, one SafeChemEdu customer account and the applicable MiniApp entitlement.
The named user may:
- access the MiniApp from a reasonable number of supported devices;
- use it for their own professional or workplace activities;
- use it across projects or workplaces for which they are personally responsible;
- create and save records;
- print and export records where those functions are provided; and
- provide completed reports or exported records to authorised recipients.
The named user must not:
- share login or account credentials;
- permit another person to operate the MiniApp through their account;
- establish a shared or generic workplace login;
- resell, sublicense, rent or provide commercial access to the MiniApp;
- copy or reproduce the application;
- reverse engineer or attempt to obtain its source code; or
- represent the MiniApp as their own software product.
5. Customer records and responsibilities
The customer is responsible for information entered into the MiniApp and for checking the accuracy, completeness and suitability of records produced.
The customer is also responsible for retaining records required for workplace, contractual, regulatory or legal purposes.
Any workplace decision, assessment or approval recorded through a MiniApp remains the responsibility of the customer or appropriately authorised workplace personnel.
6. Professional judgement and compliance
ChemData MiniApps are chemical-management support tools.
They do not replace professional judgement, workplace consultation, competent technical advice, site-specific risk assessment, Safety Data Sheet review, workplace procedures, management responsibilities or compliance with applicable legislation, regulations, codes, standards, licences or other obligations.
7. Product functions
The purpose and principal functions of each MiniApp are described in its applicable Product Schedule.
SafeChemEdu may improve, modify or enhance functionality during the licence period provided such changes do not materially remove the fundamental purpose of the purchased MiniApp.
8. Updates and support
An active licence includes access to the purchased MiniApp, updates and improvements released for that MiniApp, security and reliability updates, and reasonable email support for account and access issues.
Unless separately agreed, the licence does not include custom development, consulting, customer data entry, regulatory advice, legal advice or professional approval of customer decisions or records.
9. Renewal
The licence does not automatically renew during SafeChemEdu’s initial commercial rollout.
The customer must actively purchase or approve another 12-month licence period.
The standard standalone MiniApp renewal price is A$100 less than that MiniApp’s original purchase price, unless otherwise stated in the applicable Product Schedule or renewal offer.
SafeChemEdu will not charge the customer for renewal without the customer’s express agreement.
10. Expiry and access to records
When the licence expires:
- the customer’s ability to create or edit records stops;
- the entitlement enters a 30-day read-only grace period;
- during that period the customer may review and export existing records where those functions are available; and
- renewal during the grace period restores normal licensed access.
The customer is responsible for exporting records that must be retained.
Subject to applicable law, SafeChemEdu’s Privacy Policy and overriding retention requirements, customer MiniApp content may be retained for up to 90 days following licence expiry and may subsequently be securely deleted or de-identified.
11. Upgrade credit
The qualifying original purchase amount paid for an eligible standalone ChemData MiniApp may be credited against an eligible upgrade to:
- the ChemData MiniApps Suite; or
- ChemDataVault.
Unless otherwise stated, eligibility applies while the standalone licence is active or during its 30-day grace period.
The credit applies once to the qualifying upgrade, excludes refunded amounts and separately charged services, is not transferable, cannot be redeemed for cash and cannot reduce the upgrade price below zero.
12. Australian and international sales
SafeChemEdu’s Australian customer pricing is displayed inclusive of Australian GST where applicable.
For international transactions, Australian GST is applied only where legally applicable. Other VAT, GST, sales tax or similar taxes may apply according to the customer’s location and the relevant transaction.
Unless otherwise expressly stated, ChemData MiniApp prices are denominated in Australian dollars (AUD).
13. Suspension or termination
SafeChemEdu may suspend access where reasonably necessary because of suspected account sharing or unauthorised access, unlawful or harmful use, material breach of these terms, fraudulent or reversed payment, or a material security risk.
Where reasonably practicable, SafeChemEdu will notify the customer and provide a reasonable opportunity to correct the issue before terminating the licence.
14. Statutory rights
Nothing in these licence terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
15. Commercial entitlement
A successful qualifying purchase establishes a SafeChemEdu product entitlement.
The standard structure is:
Customer Account + Purchased Product Entitlement + Active Licence + Activation Date + Expiry Date
Possession of a MiniApp URL does not itself authorise access.
The intended access pathway is:
SafeChemEdu → Customer Login → My ChemData MiniApps → Entitlement Check → Purchased MiniApp
Source-code repository access is not included in the licence.
16. Product Schedules
Each standalone ChemData MiniApp has its own Product Schedule identifying its product number, product name, product code, purpose, principal functions, entitlement identifier, price and any product-specific conditions.
Where a Product Schedule expressly varies a product-specific matter, that Product Schedule applies to that matter. These Master Licence Terms govern all other aspects of the licence.
17. Related terms
These licence terms operate together with SafeChemEdu’s applicable:
- Terms and Conditions;
- Privacy Policy;
- Refund and Cancellation Policy;
- Customer Data provisions;
- checkout terms; and
- individual MiniApp Product Schedule.
18. Document status
These terms establish the commercial licensing framework for individually purchased ChemData MiniApps.
Final contractual wording should be reviewed by an appropriately qualified Australian commercial solicitor before full paid commercial launch.
